1. Purpose and Scope
This Privacy Policy governs the collection, processing, storage, disclosure, and protection of personal and non-personal data of users (“you”, “your”) interacting with any of our:
websites, mobile apps, and forms,
physical or online purchases of products/kits/3D prints, and
participation in competitions, workshops, or training programs.
By accessing our services, you acknowledge and consent to this Policy and to the lawful collection and processing of your data as per the Information Technology Act 2000, Digital Personal Data Protection Act 2023, and all other applicable Indian laws.
2. Data We Collect
We may collect:
Personal Data – name, contact details, email, phone, postal address, age, guardian/parent name, payment details, and school/institution data.
Usage Data – browser/device details, IP address, session analytics, cookies, location, and log data.
Transaction Data – order details, invoices, payment confirmations, refund history.
Submission Data – designs, drawings, digital 3D files (STL/STEP/CAD), prototypes, photos, competition entries, and any creative or technical material voluntarily shared.
Communications – emails, chats, calls, or messages sent to our support channels.
3. Purpose of Processing
Data may be processed for:
Order fulfilment, invoicing, delivery, and customer communication.
Verification of identity and age for competitions.
Educational, analytics, and product-improvement purposes.
Event registration, scheduling, certification, and prize disbursal.
Legal compliance, fraud detection, and security monitoring.
Marketing, testimonials, and updates (only with consent).
4. Lawful Basis
All data processing is conducted under the lawful bases of:
Contractual necessity (fulfilling purchases/services),

We retain information only as long as:

Under Sections 43, 66, 72A of the Information Technology Act 2000, any unauthorized tampering, hacking, or data theft attempts are punishable under Indian law and will be prosecuted.

8. Data Sharing and Disclosure
We do not sell personal data.

IT/security vendors under confidentiality agreements.
All such partners are bound by strict data-processing contracts consistent with Indian data-protection standards.
9. IP Ownership & Uploaded Designs
All original intellectual property created by Kinderbrainer by Flextime Solutions LLP (designs, kits, CAD models, content, curriculum, brand elements, and visuals) remains its exclusive property.
Any file, idea, or design submitted by you for 3D printing, competition, or collaboration remains your property, but you grant us a limited, non-exclusive, royalty-free license to use, process, reproduce, and fabricate solely for the purpose you requested.
Kinderbrainer by Flextime Solutions LLP shall bear no liability for IP infringement, plagiarism, patent violations, or copyright disputes arising from materials supplied by the user. The user shall fully indemnify us against all such claims, costs, or legal proceedings.
We are under no obligation to verify originality or ownership of files provided by you.
10. Your Rights
Subject to Indian law, you may:
Request access, correction, or deletion of your personal data,
Withdraw consent for optional marketing communications,
Request information on third-party processors.
Requests must be sent in writing to our official contact (see Section 16).
11. Data Transfer & Storage
All data is stored in servers located in India or jurisdictions compliant with Indian data-protection standards. Cross-border transfers, if any, are made only to entities with adequate data-protection safeguards.
12. Children’s Privacy
Our products serve educational purposes for minors under parental/guardian supervision. We collect information from minors only with verifiable parental consent. Parents may request deletion or modification of such data by written notice.
13. Legal Protection, Indemnification & Abuse Safeguards
You agree to indemnify and hold harmless Kinderbrainer by Flextime Solutions LLP, its partners, employees, agents, and affiliates against all claims, damages, penalties, or expenses arising from:
misuse of data,
unsafe or unlawful activity,
infringement of third-party IP rights through your submissions or actions,
false or misleading information provided by you.
Any abuse, hacking, or data tampering shall be treated as a criminal offence under Sections 65–67 of the IT Act 2000, Sections 405–420 of IPC (criminal breach of trust, cheating, misrepresentation), and other applicable laws.
We reserve the right to report, block, or terminate access immediately on reasonable suspicion of misuse or unlawful activity.
14. Limitation of Liability
To the fullest extent permitted by law:
Kinderbrainer by Flextime Solutions LLP shall not be responsible for any indirect, incidental, or consequential damages (data loss, business interruption, IP misuse by third parties).
Our total aggregate liability for any claim shall not exceed the value paid for the product/service concerned.
No liability arises from delay, breach, or disclosure caused by Force Majeure or third-party system failures.
15. Legal Jurisdiction & Dispute Resolution
This Policy is governed by the laws of India.
Any dispute, claim, or proceeding arising from data handling or privacy matters shall be subject exclusively to the courts at Pune or Mumbai, Maharashtra, India.
Before litigation, parties shall attempt amicable settlement within 30 days of written notice.
Arbitration (if chosen) shall be under the Arbitration and Conciliation Act 1996, seat in Pune, proceedings in English.
