Terms & Conditions

Entity: Kinderbrainer by Flextime Solutions LLP (“we”, “us”, “our”).

Website/App/Offline Sales & Services: Collectively, the “Platform” and “Services”.

1) Definitions

  • Customer/You: The purchaser, participant, parent/guardian (for minors), school, or institution using our Products/Services.

  • Products: Educational kits, components, 3D-printed parts, accessories, digital files (STL/STEP/CAD), manuals, cards, and printables.

  • Kits: Boxed sets and/or digital combinations intended for learning and DIY experimentation.

  • 3D-Printed Products: Items fabricated using additive manufacturing by or for Kinderbrainer by Flextime Solutions LLP.

  • Competitions: Contests/workshops/bootcamps/assessments/challenges organized or facilitated by Kinderbrainer by Flextime Solutions LLP.

  • Digital Content: Videos, PDFs, images, CAD files, instructions, lesson plans, and online modules.

  • Order: A paid purchase for Products and/or Services.

  • Force Majeure: Events beyond reasonable control (e.g., natural disasters, strikes, pandemics, government action, transport disruptions, cyber incidents).

2) Eligibility & Accounts

  • Purchases and competition entries must be made by adults (18+) or by minors with verifiable parental/guardian consent.

  • Schools/institutions warrant authority to bind their organization.

  • You are responsible for accurate information, securing logins (if any), and all activity under your account.

  • These terms may be  revised or edited or changed entirely with or without prior intimation to the  users of its services, products and prospected consumers.  It is advised to keep up to date log of changes before using the services or products.

3) Safety, Supervision & Intended Use (Critical Waiver)

  • Adult supervision is mandatory for users under 18.

  • Kits and 3D-printed products are educational aids only—not toys for unsupervised play, not medical devices, not PPE, not load-bearing or life-safety components, and not certified for food contact or elevated temperatures unless explicitly stated.

  • Hazards: Small parts (choking), magnets, sharp edges, heated elements, electricity/electronics, chemicals, elastic energy, moving mechanisms.

  • Use appropriate PPE (gloves, eyewear), follow manuals and local safety regulations, and perform activities in a safe environment with ventilation and clear workspace.

  • You assume all risks inherent to DIY experimentation, prototyping, tool use, 3D printing, and competitive participation.

Liability Waiver (Use & Experimentation):

By purchasing/using our Products/Services, you acknowledge and voluntarily accept all risks of injury, property damage, or loss arising from assembly, use, modification, storage, transportation, installation, and demonstration of Products or from participation in competitions/workshops. Kinderbrainer by Flextime Solutions LLP is not liable for any indirect, incidental, consequential, punitive, or special damages.

4) Orders, Pricing, Taxes & Payment

  • Prices are listed in INR unless stated otherwise and are subject to change without notice.

  • Taxes/GST, shipping, duties, and handling are extra unless explicitly included.

  • We may cancel/refuse orders for errors (pricing/availability/specification) or suspected fraud; any amount paid will be refunded.

  • Services stay on hold (hauled) if payment is not received, fails, is reversed, or is overdue. Access to content, sessions, or event participation may be suspended until dues are cleared.

5) Shipping, Risk of Loss & Inspection

  • Title and risk of loss pass to you upon delivery by our logistics partner to your address (or to the school/institution’s receiving point).

  • Inspection Window: You must inspect and report shipping damage/shortage within 48 hours of delivery with photos/videos and unboxing proof.

  • We will assist with courier claims where applicable; remedies are limited to the refund of product value or replacement at our discretion.

6) Product Specifications, Tolerances & 3D-Printing Limitations

  • 3D-printed parts may have layer lines, slight warpage, color variance, minor surface artifacts, dimensional tolerances, or visible supports—these are typical of additive manufacturing.

  • Materials (PLA/ABS/PETG/PA/Resin, etc.) have temperature, UV, moisture, and mechanical limits. Do not expose to heat sources, open flame, chemicals, or sunlight beyond material capability.

  • Unless explicitly stated, no item is certified for structural, aerospace, automotive, medical, food-contact, or outdoor long-term use.

  • Custom/Personalized 3D prints and made-to-order kits follow the exact files/specs provided by you; your files must be lawful and non-infringing. "Kinderbrainer by Flextime Solutions LLP" does not take  any responsibility of authenticating  the  origin, novelty, IP infringement or unlawful copy of the 3D files or inputs given to us.  

7) Digital Files (STL/STEP/CAD), License & Restrictions

  • Unless otherwise specified in writing, Digital Content is licensed non-exclusive, non-transferable, revocable, for personal/educational use only.

  • No resale, sublicensing, public posting/sharing, mass duplication, reverse engineering of proprietary files, or commercial manufacturing without prior written consent from Kinderbrainer by Flextime Solutions LLP.

  • You are responsible for safe slicer settings, printer profiles, infill/wall choices, and downstream risks.

8) Returns, Replacements, Cancellations & Refunds

A. Standard Products (non-custom)

  • Return request within 7 days of delivery; item must be unused, unopened, and in original packaging with all inserts.

  • Upon approval and receipt/inspection, the remedy is refund of the product value (shipping and COD charges are non-refundable). You may bear return shipping unless we shipped the wrong or defective item.

B. Custom/Personalized/Make-to-Order

  • Non-returnable and non-refundable, except for verified manufacturing defects or if we shipped an incorrect item relative to your approved proof.

  • For defects/incorrect supply, notify within 7 days with evidence; remedy is replacement or refund of the product value, at our discretion.

C. Kits with Consumables/Electronics

  • Opened consumables/electronic modules are not returnable unless Dead-On-Arrival (DOA) is reported within 48 hours with test evidence. Remedy is limited to replacement or refund of the product value.

D. Digital Content

  • Non-refundable once accessed/downloaded.

E. Order Cancellations

  • Before dispatch/production start: full refund.

  • After dispatch/production start for custom orders: refund not available except where mandatory by law.

F. Refund Method & Timeline

  • Refunds are processed to the original payment method subject to banking timelines after approval and receipt/inspection where required.

Important: In all cases, Kinderbrainer by Flextime Solutions LLP’s maximum obligation is the refund of the product value paid for the specific item.

9) Limited Warranty & Disclaimers

  • We provide a 30-day limited warranty against manufacturing defects from delivery date for standard products. Wear-and-tear, misuse, modifications, improper storage/assembly, wrong printer/slicer settings, and accidents are excluded.

  • No guarantee of learning outcomes, grades, placements, or success in competitions.

  • Except where prohibited by law, all products/services are provided “as is” and “as available”.

10) Competitions, Workshops & Events

A. Eligibility & Conduct

  • Minors require parental/guardian consent. Follow rules, deadlines, code of conduct, and safety policies of Kinderbrainer by Flextime Solutions LLP and any partner/venue.

  • Disqualification for plagiarism, IP infringement, unsafe behavior, harassment, falsified data, prohibited AI use (if rules restrict it), or rule breaches.

B. Judging & Outcomes

  • Judging criteria, panel composition, and scoring are at organizers’ discretion. Decisions are final. Ties and special awards may be resolved/modified as deemed fit.

C. Fees, Scheduling & Changes

  • Registration is confirmed only after payment realization.

  • We may reschedule, modify, or cancel an event for operational or Force Majeure reasons; remedies are limited to refund of the competition fees paid.

D. Travel, Logistics & Taxes

  • Participants bear travel, stay, visa, meals, and incidental costs unless explicitly covered. Prize taxes (if any) are the winner’s responsibility.

E. Submissions, Publicity & IP

  • You warrant submissions are original and do not infringe third-party rights.

  • By entering, you grant Kinderbrainer by Flextime Solutions LLP a limited, royalty-free license to use, display, photograph, film, publish, and share your submissions, name, and likeness for event administration, result announcements, and promotional purposes in any media, unless you opt-out in writing before the event. Sensitive student data will be handled per our Privacy Notice.

F. Competition Waiver

  • You acknowledge the inherent risks of prototyping, demonstrations, and public showcasing. Kinderbrainer by Flextime Solutions LLP bears no liability for injury, loss, or damage during preparation, travel, participation, or post-event activities. Our maximum obligation is the refund of the competition fees paid.

11) Training/Workshops/Services

  • Delivery is best-effort and may involve third-party facilitators/platforms.

  • Session timing/content can be adjusted to maintain quality or address constraints.

  • No outcome guarantees (placements, admissions, awards, certifications), unless explicitly stated in writing.

  • Services remain suspended if any payment is due; access will resume after clearance.

12) Intellectual Property (IP)

  • All trademarks, logos, brand elements, curriculum content, manuals, designs, photos, videos, CAD files, and Platform content are owned/licensed by Kinderbrainer by Flextime Solutions LLP.

  • You receive only the limited license specified in Section 7. No implied licenses.

  • Use of our trademarks requires prior written permission.

13) User Content & Feedback

  • You are responsible for the legality and safety of materials/files you upload or provide.

  • You grant us a non-exclusive license to use your feedback/suggestions to improve Products/Services without obligation.

14) Third-Party Tools, Partners & Links

  • We may integrate or refer to third-party services (payments, couriers, LMS, conferencing). Their terms apply separately. We are not responsible for their performance, availability, or security.

15) Compliance, Export & Local Laws

  • You must comply with applicable Indian laws and any local regulations applicable to your jurisdiction, including export controls if you transfer technology/files cross-border.

16) Privacy

  • Personal data is processed per our Privacy Notice (link/reference). By using our Services, you consent to such processing and communications for order and service purposes. You may opt-out of marketing communications at any time.

17) Indemnity

  • You agree to indemnify, defend, and hold harmless Kinderbrainer by Flextime Solutions LLP, its partners, employees, and agents from claims/losses arising from your breach of these Terms, unsafe use, infringement of IP, or violation of law.

18) Limitation of Liability (Cap on Remedies)

  • To the fullest extent permitted by law, Kinderbrainer by Flextime Solutions LLP’s total aggregate liability for any claim arising out of or relating to Products/Services shall not exceed the amount you actually paid for the product value or the competition fees paid, as applicable.

  • We disclaim all indirect, incidental, consequential, punitive, or special damages (including lost profits, lost data, business interruption), even if advised of the possibility.

19) Force Majeure

  • We are not liable for delays/failures due to Force Majeure. Where events are canceled for such reasons, your exclusive remedy is refund of the product value or competition fees paid, as applicable.

20) Service Suspension & Termination

  • We may suspend or terminate access for non-payment, suspected fraud, misuse, or violations of these Terms. Outstanding dues remain payable.

21) Changes to Terms, Products & Pricing

  • We may update these Terms, specifications, or pricing at any time. Changes apply prospectively from publication. Continued use signifies acceptance.

22) Dispute Resolution, Governing Law & Jurisdiction

  • Governing Law: Laws of India.

  • Good-Faith Resolution: Parties shall attempt amicable resolution within 30 days of a written notice of dispute.

  • Arbitration: Unresolved disputes shall be finally settled by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed mutually (or per the Act), seat/venue: Pune, Maharashtra, language: English.

  • Courts: Subject to arbitration, courts at Pune, Maharashtra shall have exclusive jurisdiction.

23) Notices & Contact

  • Legal notices must be sent to the registered address/email of Kinderbrainer by Flextime Solutions LLP (insert address and official email). Customer support queries may be directed to [insert support email/phone/WhatsApp].

24) Severability & No Waiver

  • If any provision is held unenforceable, the remainder remains in effect. Failure to enforce any provision is not a waiver.

25) Entire Agreement

  • These Terms, along with order confirmations, written policies (Returns/Privacy/Competition Rules), and any executed statements of work constitute the entire agreement between you and Kinderbrainer by Flextime Solutions LLP.
